By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you may not access or use the Services.

2. Account Registration and Security

  • You must provide accurate and complete information when creating an account.
  • You are responsible for safeguarding your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

3. Use of AI Services

MakeTheStartup provides AI-assisted guidance for startups. By using these features, you acknowledge that:

  • Not Professional Advice: The AI-generated content (including business roadmaps, financial models, and legal suggestions) is for informational and educational purposes only. It does not constitute professional legal, financial, or tax advice. You should consult appropriate professionals before making significant business decisions.
  • Accuracy Not Guaranteed: While we strive for high quality, AI-generated content may contain errors, inaccuracies, or outdated information. AI is not always correct, so when the AI gives an answer, please verify it. You are responsible for verifying any critical information.
  • Fair Use: Prompt limits apply based on your subscription tier. Automated scraping, reverse engineering, or exploiting the AI endpoints to bypass these limits is strictly prohibited and will result in immediate account termination.

4. Startup Submissions and Content

When you submit a startup or post content to our community:

  • Data Accuracy & Verification: We strive to provide 99.9% verified and well-researched startups on our platform. However, if you find any startup with wrong information, please contact our team immediately so we can correct it.
  • Ownership: You retain all ownership rights to your original content and startup intellectual property.
  • License: By submitting content, you grant MakeTheStartup a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your public content on our platform for the purpose of operating the Services.
  • Accuracy: You represent that the information you provide about your startup is accurate and not misleading.
  • Moderation: We reserve the right to review, approve, reject, or remove any startup listing or community post at our sole discretion, without notice, if we believe it violates these Terms or our community guidelines.

5. Payments and Subscriptions

  • Digital plans: Paid plans provide digital access for the one-month or yearly duration selected at checkout. The plan, price, currency, taxes, fees, and duration are shown before payment.
  • Payment processing: Razorpay processes payments. We store order, transaction, subscription, and payment-status references, but do not store card numbers, CVV, UPI PINs, or banking passwords.
  • Taxes: Base prices exclude applicable taxes (e.g., GST). Taxes and processing fees will be calculated and displayed at checkout.
  • Cancellations and refunds: Cancellation and refund rules are described in our Cancellation & Refund Policy.
  • Changes to Pricing: We reserve the right to change our pricing. We will provide at least 30 days notice before any price changes take effect for existing subscribers.

6. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Harass, abuse, or harm other users in the community.
  • Submit spam, deceptive content, or startups that do not exist.
  • Attempt to bypass rate limits, security measures, or payment systems.
  • Use the AI to generate harmful, illegal, or malicious content.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKETHESTARTUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Digital delivery and access

Services are delivered digitally through the website after successful payment verification. No physical product is shipped. Access may depend on account status, plan limits, and service availability.
